Use of the site

Eligibility

Access to and use of goagameswin.in.net (the "Site") is permitted only to individuals who are at least 18 years of age and are legally capable of entering into binding contracts under applicable Indian law. By accessing the Site, you confirm that you meet these eligibility requirements. Goa Games reserves the right to verify eligibility at any time and to suspend or terminate access where requirements are not met.

Permitted use

You may use the Site solely for lawful, personal, and non-commercial purposes in accordance with these Terms of Service. You agree not to attempt to gain unauthorised access to any part of the Site, its servers, or any system or network connected to the Site; use automated tools, bots, scrapers, or other means to extract data without the express written consent of Goa Games; upload or transmit any content that is defamatory, obscene, fraudulent, or otherwise objectionable; or interfere with or disrupt the integrity or performance of the Site or its related services.

Account and payment responsibilities

If you create an account on the Site, you are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Where the Site supports payments, transactions conducted through UPI-enabled platforms such as PhonePe, Google Pay (GPay), or BHIM are subject to the terms and policies of those respective platforms in addition to these Terms. Goa Games is not a party to the payment transaction itself and will not be liable for any failed, delayed, or disputed transactions originating with a third-party payment provider.

You must notify Goa Games immediately upon becoming aware of any unauthorised use of your account or any payment discrepancy.

Intellectual property

Ownership

All content on the Site, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, software, game assets, and compilations thereof, is the exclusive property of Goa Games or its licensors and is protected under the Copyright Act, 1957 (India), the Trade Marks Act, 1999 (India), and other applicable intellectual property laws. The Goa Games name, logo, and all related marks, trade names, and service names are trademarks of Goa Games. Unauthorised use of any such marks is strictly prohibited and may attract civil and criminal liability under Indian law.

Limited licence

Goa Games grants you a limited, revocable, non-exclusive, non-transferable licence to access and use the Site for personal, non-commercial purposes as expressly permitted by these Terms. This licence does not include resale or commercial exploitation of the Site or its content; reproduction or duplication of any content for commercial gain; collection of account information or pricing data for the benefit of a third party; or any derivative use of game assets, graphics, or underlying software. Any use outside the scope of this licence requires the prior written approval of Goa Games.

User-submitted content

If you submit, post, or otherwise make available any content on the Site, including reviews, comments, or gameplay feedback, you grant Goa Games a worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, publish, and distribute such content in any media. You represent and warrant that you own or have the necessary rights to grant this licence and that the content does not infringe the intellectual property or privacy rights of any third party.

Limitation of liability

Disclaimer of warranties

The Site and all content, services, and features made available through it are provided on an "as is" and "as available" basis without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Goa Games does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, nor does it warrant the accuracy, completeness, or timeliness of any content on the Site.

Exclusion of consequential damages

To the fullest extent permitted by applicable Indian law, Goa Games, its directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your access to or use of the Site, including but not limited to loss of revenue, loss of profits, loss of data, or loss of goodwill, even if Goa Games has been advised of the possibility of such damages. This exclusion applies regardless of the theory of liability, whether in contract, tort, negligence, or otherwise.

Cap on liability

Where liability cannot be fully excluded under applicable law, the total aggregate liability of Goa Games to you for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the greater of INR 500 or the amount you paid to Goa Games in the thirty (30) days immediately preceding the event giving rise to the claim. Nothing in these Terms limits or excludes liability for fraud, wilful misconduct, or death or personal injury caused by Goa Games' negligence.
